These Terms and Conditions (“Terms”) govern your access to and use of the SCUBA Host website at scubahost.com (the “Site”) and your enrollment in courses, booking of scuba trips, and participation in any activities offered by SCUBA Host (“SCUBA Host,” “we,” “us,” or “our”). By accessing the Site or using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Eligibility
You must be at least 18 years of age to enter into these Terms on your own behalf. Participants under 18 may use our services only with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on the minor’s behalf.
2. Courses, Trips, and Bookings
All course enrollments and trip bookings are subject to availability and confirmation by SCUBA Host. We reserve the right to modify course schedules, dive sites, itineraries, or instructors due to weather, safety conditions, participant readiness, or other circumstances beyond our reasonable control. Certification is subject to your meeting the applicable training-agency standards and is not guaranteed by enrollment or payment.
3. Payment
Payment is due at the time of booking unless otherwise agreed in writing. All fees are stated in U.S. dollars. You agree to provide current, complete, and accurate payment information. Prices are subject to change, but confirmed bookings will be honored at the price in effect at the time of booking.
4. Cancellations and Refunds
Cancellation and refund terms will be provided at the time of booking and may vary by course or trip. Because diving activities require advance planning and reserved capacity, cancellations made close to the scheduled date may be non-refundable in whole or in part. SCUBA Host reserves the right to cancel any course or trip, in which case affected participants will be offered a rescheduled date or a refund of amounts paid for the cancelled activity.
5. Assumption of Risk and Waiver
You acknowledge that scuba diving and related activities are inherently dangerous and involve the risk of serious injury or death. You voluntarily assume all such risks. As a condition of participation, you may be required to sign a separate written waiver, release of liability, and assumption-of-risk agreement in accordance with Florida law. You agree to comply with all safety rules and the instructions of SCUBA Host staff at all times.
6. Participant Conduct and Responsibilities
You agree to provide accurate certification and medical information, to dive within the limits of your training and the applicable dive plan, and to conduct yourself in a manner that does not endanger yourself or others. SCUBA Host may, in its sole discretion and for safety reasons, refuse or discontinue any participant’s involvement in an activity without refund where conduct or fitness presents a safety concern.
7. Intellectual Property
All content on the Site, including text, graphics, logos, images, and course materials, is the property of SCUBA Host or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.
8. Disclaimers and Limitation of Liability
The Site and our services are provided on an “as is” basis. To the fullest extent permitted by Florida law, SCUBA Host disclaims all warranties, express or implied, and shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or participation in our activities. 9. Indemnification
You agree to indemnify, defend, and hold harmless SCUBA Host and its owners, employees, instructors, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your violation of any law, or your participation in any activity offered by SCUBA Host, to the extent permitted by Florida law.
10. Governing Law and Venue
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
11. Severability
If any provision of these Terms is found to be unenforceable under Florida law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective Date” above. Your continued use of the Site or our services after any changes constitutes your acceptance of the revised Terms.
